Below is some useful information, which I think you will find helpful:


- To file your divorce in California, you must have been a resident of this State for at least six months and a resident of the County which you are filing in for at least three months.  This is the general rule for filing a divorce Petition.


- Before you will be granted a divorce in California, there is a six month waiting period.  Usually the six month period starts from the date in which the other party is served the divorce Petition.

 
-If you cannot afford court fees, you may qualify for
a fee waiver if you meet the guidelines.

-Your divorce will usually end in one of two ways.  Either the parties come to an agreement and have this agreement incorporated into the Judgment for Dissolution.  The other way is when the parties cannot come to an agreement; there will be a trial which will finalize their case.


-Usually, before a trial date is set, the court will set a Mandatory Settlement Conference.  This is a mechanism by which the parties will meet with a Judge Pro Tem and this Judge Pro Tem will try to facilitate a settlement between the parties by giving them a realistic view of how the trial Judge may rule on their issues.


-In disputes involving child custody and visitation, the court will make both parties attend Family Court Services Mediation (FCS).  It is very important to be well prepared for this mediation because often times, the Judges go by the FCS recommendations.
